A man from Mombasa has moved to court seeking custody of his child, citing deeply disturbing allegations against his former partner, whom he accuses of engaging in explicit sexual acts with a foreign national in the presence of both their minor child and a dog.
The petitioner, identified in court documents as A.M.A.Z, has filed an affidavit before the Tononoka Law Courts under case number MCCHCC/E404/2024, arguing that his child is being exposed to an environment that is not only immoral but also psychologically damaging.
According to the affidavit, the woman at the center of the controversy has been identified as Mwanaisha Said Mohamed, while her alleged accomplice is a German national named Schmidt Harry.
The petitioner has invoked provisions of the Children Act 2022, accusing the mother of violating key sections of the law, including exposing a child to emotionally traumatic and age-inappropriate content and engaging in activities that constitute child sex tourism and trafficking.
A graphic video that has surfaced and been reviewed by multiple sources reportedly depicts the German national engaging in explicit sexual acts with Mwanaisha Said Mohamed, with their dog participating in the activities.
The footage, which was purportedly recorded at Lakeview Estate 5, House Number 8, in Bamburi, Mombasa County, shows the couple engaging in sexual intercourse in a room filled with alcoholic beverages.
Shockingly, the recording allegedly captures the animal being permitted to lick the private parts of both individuals before engaging in sexual activity with the woman.
The video also appears to show Harry live-streaming the incident, raising concerns that he may be involved in the production and distribution of commercial sex videos.
The petitioner has urged the court to find the mother and her lover guilty of actions that contravene multiple legal provisions relating to child protection, asserting that they have engaged in the use, persuasion, inducement, enticement, and coercion of a child to witness sexually explicit conduct.
The petitioner contends that the mother has subjected their child to an environment that is both unhygienic and morally reprehensible, raising questions about the minor’s safety and welfare.
Allegations have emerged implicating officers within the Bamburi Tourism Police Unit in efforts to shield the German national from legal action.
Multiple sources indicate that these officers have obstructed justice, allowing him to remain free despite the availability of evidence warranting his immediate arrest.
Bamburi Tourism Officer Christopher Mwanjala and his deputy have been named as key figures in assisting Harry to evade law enforcement.
Witnesses report that Mwanjala was seen at the German national’s residence alongside Mwanaisha’s lawyer, an interaction that took place shortly before the matter came to public attention.
Additional reports suggest that Harry has acquired property in Mombasa with assistance from local authorities, deepening suspicions of corruption within the system.
Residents have voiced outrage, demanding a full investigation into whether members of the police force have aided the foreign national.
The Directorate of Criminal Investigations (DCI) is under pressure to establish the extent of his activities and determine whether law enforcement officers have colluded in protecting him from arrest.
There are also fears that the German national may attempt to flee the country to evade prosecution.
Some residents have raised alarms over his potential involvement in the underground production and sale of illicit pornography, including bestiality content.
They are now calling on the Directorate of Criminal Investigations (DCI) to conduct a thorough probe into his activities and possible connections to an international network of criminal enterprises.
The matter was brought before Principal Magistrate Nelly Chepchirchir on 12th February 2025 for directions on the petitioner’s notice of motion, which was filed on the same day.
Meanwhile, authorities are reportedly investigating whether the woman was coerced or drugged into engaging in the acts captured in the video.
Concerns have also emerged over her health status, with suspicions that Harry may have infected her with sexually transmitted diseases and subsequently advised her on the necessary medication to take.
